The 40% and 80% Thresholds

The RPWD Act 2016 defines two key thresholds that determine the level of benefits:

Section 80U vs Section 80DD

These are often confused:

  • Section 80U: Deduction claimed by the person with disability themselves. Fixed deduction — ₹75,000 (40%+) or ₹1,25,000 (80%+). No actual expenditure required.
  • Section 80DD: Deduction claimed by the individual who incurs expenditure on the disabled dependent (spouse, children, parents, siblings). Same limits apply. Requires proof of actual expenditure on medical treatment, rehabilitation, or an insurance policy for the dependent.

Getting a UDID Card

The Unique Disability Identity (UDID) card replaces old disability certificates. It is issued free of cost and can be applied for online at swavlambancard.gov.in. The process:

  1. Register online with Aadhaar, photo, disability certificate details
  2. Visit your district hospital/designated medical authority for assessment

Frequently Asked Questions

Can I claim both Section 80U (for myself) and Section 80DD (for my disabled child) in the same year?

Yes. If you yourself have a disability (qualifying for Section 80U) AND you also maintain/insure a disabled dependent child, you can claim both deductions in the same year. The total deduction would be ₹1,50,000 (₹75,000 × 2) at 40%+, or up to ₹2,50,000 if both are 80%+ severe disability.

My state's disability certificate says 45%. Can I get a UDID with a different percentage?

The UDID is issued after assessment by the designated medical authority under the central government's system. The percentage in your UDID may differ from an older state certificate. The UDID percentage is what governs central government benefits. If you disagree with the assessment, you can appeal to the Chief Medical Officer of your district.

Is there a railway concession for attendants travelling with disabled persons?

Yes. For persons with severe or multiple disabilities (80%+), an attendant travelling on the same train also gets the same concession as the disabled person (75% in 2nd Class/Sleeper, etc.). The attendant concession is available only when travelling together with the disabled person.

What job reservation exists for persons with disabilities in private companies?

Under the RPWD Act 2016, the 4% reservation applies to Central Government establishments and Central Public Sector Undertakings. Private companies are not legally required to have a reservation — but are encouraged under the RPWD Act to provide "reasonable accommodation." The Act does prohibit discrimination in employment and requires accessible workplaces for establishments above 20 employees.
